Bad Faith

Ken Hooks has a long history of representing clients who have been unfairly denied benefits or protection under their insurance policies. Our firm handles all types of bad faith insurance cases, including:

                  • Auto Insurance Claims

                  • Homeowner Coverage

                  • Business Insurance Claims

                  • Life Insurance Claim Denials

                  • Disability Insurance Claims

                  • Health Insurance Claims

In the United States, most courts have held that a special relationship exists between an insurance company and its insured, requiring the insurance company to act in good faith toward its insured. In particular, this means that the insurance company is under an obligation to pay when it becomes reasonably clear that a claim is covered. An insurance company is required by law to provide you with the coverage outlined in your policy in exchange for the premiums you pay. If a company defaults on its contractual obligations and does not act in good faith toward policyholders, the policyholder can bring a case against the insurer. Taking insurance companies to court is not only the appropriate way to get the funds that you were denied, it also holds these companies accountable for illegal practices and forces them to do business the right way for their other policyholders.

Types of Bad Faith Claims

With regard to claims made against you by others, acting in bad faith may include such actions as refusing to provide coverage for a claim, refusing to provide a lawyer to defend you, failing to investigate a claim and unreasonably exposing you to a verdict or judgment in excess of your policy limits.  With regard to claims made by you, acting in bad faith may include, denying payment of valid claims, delaying payment of a valid claim, underpaying a valid claim, failing to investigate a claim and other unfair and unscrupulous acts.

If your insurance company has acted in bad faith, you may have a right to compensation for the amount of your insurance claim, the amount of any excess verdict against you, emotional damages and punitive damages. If you believe your insurance company has failed to act in good faith, and you or your business have suffered a significant loss, please contact us for a prompt no-cost, no-obligation consultation.

Fraud

While bad faith claims are typically limited to insurance companies in Alabama, other types of fraud claims can be brought against any individual or business that wrongfully causes economic loss or emotional injuries through unfair or illegal conduct. These claims arise in situations where the wrongdoer fraudulently induces another to act to their detriment and may include such conduct as innocently, recklessly or intentionally misrepresenting material facts, or wrongfully withholding material information that should have been disclosed. If you believe you have been defrauded by any individual or business entity, and you or your business have suffered a significant loss, please contact us for a prompt no-cost, no-obligation consultation.
