All too often, the care and maintenance of an elderly loved one can be too much for a family to undertake alone and a professional care service or nursing home is the only option. Many of these services and homes are staffed by caring and trustworthy caregivers, but, sadly, many are not. In spite of federal and state laws intended to reduce patient injuries, nursing home neglect and abuse remains a serious problem in Alabama and elsewhere.
Ken has extensive knowledge of the nursing home industry and experience in the area of nursing home litigation. In fact, during his tenure as President of the Alabama Trial Lawyers Association, Ken successfully lead the opposition in the Alabama Legislature to a session-long effort by the nursing home industry to severely limit the rights of victims of nursing home abuse.
Some of the most common types of nursing home abuse or neglect include:
Neglect
The most serious patient neglect occurs when nursing home personnel fail to appropriately monitor a patient's medical condition with regard to such issues as nutrition, hydration, medication, hygiene, respiration, circulation and traumatic injury. Patient neglect can lead to serious injury or death from such things as malnutrition, dehydration, medication errors, tissue ulceration, blood loss, organ damage and massive infection.
Physical Abuse
Physical abuse can include physically striking or bullying patients; improperly or inappropriately restraining patients; over-medicating patients; coercing patients to consume food or liquids; and, inappropriately punishing patients by denying nutrition, medications, hygiene or other rights and privileges.
Sexual Abuse
Sexual abuse is quite possibly the most deplorable act that any nursing home employee or caretaker can be associated with. Nursing home sexual abuse arises when someone participates in a sexual act with a resident in which the elder did not give consent. Sometimes, the resident is incapable of communicating, and a staff member will take advantage of them.
Psychological Abuse
Psychological abuse occurs when a caretaker knowingly causes a resident emotional torment through verbal or nonverbal behavior. Such abuse may be carried out through abusive language or tone, inappropriate teasing and humiliation, bullying, physical threats, sexual threats, disassociation of the patient from a caretaker or a group and isolation.
