A medical device is defined generally as an instrument, apparatus, implant, or similar item that is used to diagnose, prevent, or treat disease or other conditions. A medical device does not achieve its purpose through chemical action. Those agents are referred to as drugs or pharmaceuticals.

Before a medical device can be sold in the United States, the manufacturer must put the device through testing and trials. The manufacturer then must submit the devise to the Food and Drug Administration (FDA) for approval before the device can be distributed in the United States. Due to its limited resources, the FDA is unable to carefully test and screen all such devices or surgical tools. Sometimes, the FDA approves a new device on the basis of its "substantial similarity" to an already existing device. Unfortunately, this can and has led to instances where a device has been approved and it is later discovered that the device is defective as failures occur after the device or implant has been placed in patients.

 

Product defects are often the result of rushing a product to market without careful product design, failing to adequately test the way the product will be utilized in its environment of use and failing to adequately warn and instruct product users or patients.
