Sometimes, the FDA approves a new device on the basis of its "substantial similarity" to an already existing device. Unfortunately, this can and has led to instances where a device has been approved and it is later discovered that the device is defective as failures occur after the device or implant has been placed in patients.
Product defects are often the result of rushing a product to market without careful product design, failing to adequately test the way the product will be utilized in its environment of use and failing to adequately warn and instruct product users or patients.
